Terms of Service

Welcome to Splits. By accessing or using the Splits mobile application, website at trysplits.com, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Splits. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

2. Account Registration

To use certain features of Splits, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Description of Service

Splits is a bill-splitting application that allows users to photograph receipts, extract line items using AI, and share a link so participants can claim their items. The Service calculates each person's fair share, including proportional tax and tip.

Splits is a calculation and coordination tool. We do not process payments, transfer funds, or act as a financial intermediary. Settlement of debts between users is handled outside of the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload content that is fraudulent, misleading, harmful, or infringes on the rights of others
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission
• Interfere with or disrupt the Service or the servers and networks that host it
• Reverse engineer, decompile, or disassemble any part of the Service

5. User Content

You retain ownership of content you upload to Splits, including receipt images. By uploading content, you grant us a limited, non-exclusive license to use, process, and store that content as needed to provide and improve the Service. Receipt images are processed by AI to extract billing information and are stored securely in accordance with our Privacy Policy.

6. AI-Powered Features

Splits uses artificial intelligence to read and interpret receipt images. While we strive for accuracy, AI-generated results may contain errors. You are responsible for reviewing and confirming the accuracy of extracted items, prices, and calculations before finalizing a split. Splits is not liable for inaccuracies in AI-processed data.

7. Participant Access

When you share a split link, anyone with that link can access the split, view items, and claim what they owe. You are responsible for sharing links only with intended participants. We are not responsible for unauthorized access resulting from shared links.

8. Pricing and Payments

Splits currently offers its core features for free. We may introduce optional premium features or subscription plans in the future. Any paid features will be clearly identified, and you will not be charged without your explicit consent. Pricing, billing, and refund policies for any future paid features will be communicated at that time.

9. Intellectual Property

The Splits name, logo, design, and all related trademarks, trade names, and visual elements are the property of Splits. The Service, including its software, design, text, and graphics, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Splits and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to errors in AI-processed receipt data, disputes between users over split amounts, or any loss of data.

12. Indemnification

You agree to indemnify and hold harmless Splits, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (such as limitations of liability and indemnification) will remain in effect.

14. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada.
